PUBLIC CONTRACT (OFFER)

About providing virtual private server (VPS) services

This agreement is an official public offer of an individual Shulga Oleksandr Ihorovych (hereinafter referred to as the "Contractor") for any individual or legal entity (hereinafter referred to as the "Customer") to provide VPS hosting services.

1. General provisions

1.1. The Contractor provides services for the placement of a virtual private server (VPS) on the terms of this Agreement.
1.2 This Agreement is a public offer in accordance with Article 633 of the Civil Code of Ukraine.
1.3. Acceptance of the terms of the Agreement (acceptance) shall be made by the Customer by paying the cost of services.

2. Subject of the agreement

2.1. The Contractor provides the Customer with access to the VPS with the specified technical characteristics.
2.2. Services are provided on a prepaid basis according to the selected tariff.

3. Rights and obligations of the parties

3.1 The Contractor undertakes to:

  • Provide access to the VPS according to the parameters selected by the Customer.
  • Provide technical support within the agreed terms and conditions.

3.2. The Customer undertakes to:

  • Use VPS only for legitimate purposes.
  • Do not use the resources for spamming, phishing, distributing malware, violating copyrights or Ukrainian legislation.
  • Pay for services in a timely manner.

4. Procedure for the provision of services

4.1 The service is activated within 24 hours from the moment the funds are received.
4.2. Access to the server is provided by e-mail to the Customer or through the personal account (if provided).

5. Payment procedure

5.1. The cost of services is determined on the Contractor's website: https://vpsio.cloud
5.2. Payment is made through the payment systems available on the website.

6. Responsibility of the parties

6.1. The Parties shall be liable in accordance with the current legislation of Ukraine.
6.2. The Contractor shall not be liable for:

  • Actions or omissions of third parties;
  • Interruptions in the Internet;
  • Loss or leakage of data caused by the Customer's negligence.

7. Force majeure

7.1. The Parties shall be released from liability for failure to fulfill their obligations in the event of force majeure (war, natural disaster, man-made disasters, cyber attacks, etc.).

8. Term of the agreement

8.1 This Agreement shall enter into force upon acceptance and shall remain in force until termination of the use of the Services.
8.2. The Customer may terminate the use of the Services at any time without a refund.

9. 9. Other conditions

9.1. The Contractor has the right to make changes to this Agreement by posting it on the Website.
9.2. The new terms and conditions shall come into force 5 (five) days after publication.
